These Terms and Conditions (“Terms”) govern your access to and participation in the campaign located at themarsvolta.com/UBLSL (the “UBLSL Website”), operated by The Mars Volta (“we,” “us,” or “our”). By accessing or participating in the UBLSL Website, you agree to be bound by these Terms. If you do not agree, please do not use the UBLSL Website.

1. Eligibility

By participating in any aspect of the UBLSL Website — including voting, submitting your email address, or otherwise engaging with the Campaign — you represent that:

• You are at least 13 years of age (or the age of majority in your jurisdiction, if higher);
• You have the legal capacity to agree to these Terms; and
• Your participation complies with all applicable laws and regulations in your jurisdiction.

2. How Voting Works

The UBLSL Website may feature one or more votes or polls that allow you to express a preference or choice. The following rules apply to all voting activity:

a. One Vote Per Person

Each participant is permitted one (1) vote per voting prompt, unless otherwise stated. We reserve the right to use technical measures — including IP address tracking, cookies, or device fingerprinting — to detect and invalidate duplicate votes.

c. Vote Integrity

Any attempt to manipulate, falsify, or game the voting process — including through automated submissions, bots, VPNs used to circumvent vote limits, or coordinated inauthentic behavior — is strictly prohibited. We reserve the right to disqualify any votes we reasonably believe to have been cast fraudulently or in violation of these Terms.

d. Voting Period

Votes will be accepted only during the designated voting window, which will be communicated on the UBLSL Website. Submissions received outside of this window will not be counted. We reserve the right to extend, shorten, or close the voting period at our sole discretion.

e. No Vote Guarantee

Casting a vote does not guarantee any particular outcome, reward, or entitlement. Votes are collected and tabulated at our discretion.

3. Handling and Announcement of Results

We reserve the right to:

• Tabulate and verify all votes before announcing any results
• Delay, withhold, or modify the announcement of results at our sole discretion
• Disqualify votes found to violate these Terms or the voting integrity standards above
• Announce aggregate results publicly, without attribution to individual voters

All voting results are final once officially announced by us. We are not obligated to disclose specific vote counts or the methodology used to tabulate results unless required by applicable law.

4. Outreach to Participants

By participating in the UBLSL Website, you acknowledge that we may contact you in connection with:

• The outcome of a vote or poll in which you participated
• Any follow-up communication required to fulfill obligations arising from the campaign
• Newsletter or update communications, if you have separately provided your email address

We will not use your contact information for unrelated commercial marketing without your separate consent. You may opt out of email communications at any time by following the unsubscribe instructions included in any email we send you.

5. No Claim Over Voting Outcomes

By casting a vote on the UBLSL Website, you acknowledge and agree that:

• Your participation in any vote constitutes an expression of preference only. It does not create any legal, creative, or commercial claim of any kind over the subject matter of the vote, its outcome, or any work, product, recording, release, or other result that may arise from or be informed by that outcome.
• The Mars Volta and its affiliates, partners, and associated artists retain full and exclusive rights to use, exploit, develop, modify, license, or otherwise act upon the outcome of any vote in any manner they see fit, at their sole discretion, without any obligation to notify, credit, compensate, or seek approval from participants.
• No participant shall be entitled to any form of credit, attribution, royalty, compensation, or recognition — whether financial, artistic, or otherwise — as a result of their vote or the outcome of any vote.
• The act of voting does not constitute a contribution to any creative work, and no participant shall have any claim under copyright, moral rights, or any other intellectual property or legal framework by virtue of their participation.

These exclusions apply regardless of how the outcome of any vote is ultimately used, including but not limited to use in recordings, releases, performances, merchandise, marketing materials, or any other commercial or artistic context.

6. Intellectual Property

All content on the UBLSL Website — including text, graphics, logos, images, audio recordings, music, sound recordings, and all other materials — is the property of The Mars Volta or its licensors and is protected by applicable intellectual property laws, including copyright. You may not copy, reproduce, distribute, perform, display, transmit, or create derivative works from any content on the UBLSL Website, including any audio content, without our prior written consent.

7. Prohibited Conduct

You agree not to:

• Use the UBLSL Website for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any part of the UBLSL Website or its underlying systems
• Interfere with or disrupt the UBLSL Website’s operation
• Submit false, misleading, or fraudulent information
• Harass, intimidate, or harm other participants

8. Disclaimers

THE CAMPAIGN SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE CAMPAIGN SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE CAMPAIGN SITE IS AT YOUR OWN RISK.

9. Limitation of Liability

To the fullest extent permitted by applicable law, The Mars Volta and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the UBLSL Website, even if we have been advised of the possibility of such damages.

10. Modifications

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued participation in the UBLSL Website after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through good-faith negotiation, and if unresolved, through appropriate legal channels in the applicable jurisdiction.
